    Senator Stollings moved to amend the amendment in section six following subsection (b) and inserting the following:

    “(c) The penalties set forth in subsection (a) of this section shall not apply when an abortion necessitated by a medical emergency occurs in a emergency room or secondary or tertiary care hospital setting. The provisions of this subsection are not applicable to a clinic that performs abortions not necessitated by a medical emergency.”
